Terms of service

These terms are between Akashi Labs ("Stashed", "we", "us") and the person or organisation that opens an account to run a shop ("you", "the merchant"). They govern your use of the Stashed platform, the merchant dashboard, and any storefront you publish through it.

They do not govern the relationship between you and your customers. What you sell, to whom, on what terms, and with what returns policy is your business and yours alone — see "Your shop is yours" below.

By opening an account you accept these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

Stashed is hosted software for building and running an online shop. That includes a page builder, product and inventory management, payment processing through our payment providers, order management, shipping tools, email, analytics, and a public storefront served from our infrastructure or from a custom domain you connect.

We provide the platform as a service. We do not sell your products, hold your inventory, act as your agent, or become a party to any sale you make.

We improve and change the platform continually. Features may be added, altered or withdrawn. Where a change removes a capability you actively rely on, we will give reasonable notice.

You are responsible for the security of your account credentials and for everything done through your account. Tell us promptly if you believe it has been accessed without your authorisation.

You must be able to form a binding contract, and you must not use Stashed if you are barred from doing so under applicable law.

You may invite other people to your shop and grant them roles. You remain responsible for what they do.

You own your products, your content, your customer relationships and your brand. We claim no ownership of any of it.

You grant us only the licence we need to operate the service: to host, store, reproduce, adapt for display, and transmit your content for the purpose of running your shop and showing it to your customers. That licence ends when you delete the content or close your account, subject to backups aging out and to any retention the law requires of us.

You are responsible for the legality of what you sell, for the accuracy of your listings and prices, for your own consumer-law obligations, for your tax obligations, and for the terms, privacy notice and returns policy you present to your customers.

Stashed charges a subscription fee and a percentage of sales made through the platform. The current amounts are shown on the pricing page and in your dashboard.

Payment processing fees are charged separately by the payment provider and are not ours. We do not mark them up.

Subscription fees are billed in advance and are not refundable except as set out in our refunds policy or as required by the Australian Consumer Law. Platform fees are deducted as sales settle.

We may change our fees. We will give you at least 30 days notice before an increase takes effect, and you may cancel before it does.

Your use of Stashed is subject to our acceptable use policy, which forms part of these terms. It sets out what may not be sold or done on the platform.

We may remove content, suspend a shop, or close an account that breaches that policy. Where the circumstances allow it, we will tell you first and give you an opportunity to put it right. Where they do not — an immediate legal risk, a payment-provider requirement, an active harm to customers — we may act first and explain afterwards.

We work to keep the platform available and to make storefronts fast, but we do not promise uninterrupted service. Maintenance, third-party outages and faults happen.

We do not currently offer a contractual uptime commitment. If we introduce one it will be published as a separate service level agreement.

You may cancel at any time from your dashboard. Your shop stays live until the end of the period you have paid for, and then stops being served.

We may end this agreement on reasonable notice, or immediately where you have materially breached it or where continuing would expose us or your customers to legal or financial risk.

After an account closes we retain your data for a limited period so it can be recovered if the closure was a mistake, and then delete it. Records we are required to keep — transaction records, for example — are retained for as long as the law requires.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that applies under the Australian Consumer Law or other law and cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of goodwill, or loss of data, and our total liability arising out of or in connection with the service in any twelve-month period is limited to the fees you paid us in that period.

You are responsible for your own dealings with your customers, including refunds, disputes and chargebacks arising from your sales.

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.

We may update these terms. Material changes will be notified by email or in the dashboard before they take effect. Continuing to use the platform after that means you accept the updated terms.
